Which SLAs matter most when choosing an EOR platform?
Service level agreements (SLAs) are the contractual commitments that hold your employer of record (EOR) provider accountable. Before signing with any platform, you need clarity on what’s guaranteed — and what happens when standards slip.
The most critical SLAs for EOR platforms typically cover:
- Payroll accuracy and timeliness — expect 99%+ accuracy and on-time payment guarantees every cycle
- Employee onboarding speed — best-in-class providers commit to 48–72 hours for standard countries, with clear timelines for complex jurisdictions
- Compliance and contract generation — locally compliant employment agreements delivered within agreed turnaround windows
- Issue resolution and support response — defined first-response times (often under 4 hours for critical issues) and escalation paths
- Offboarding and termination processing — SLAs covering statutory notice management and final pay calculations
Always ask for penalty or remediation clauses if SLAs are missed. A provider unwilling to put consequences in writing likely lacks confidence in their own delivery.
Don’t overlook Permanent Establishment risk
Many EOR providers focus solely on employment compliance but neglect the corporate tax exposure they may be creating for your business. When you employ senior decision-makers or sales-generating staff through an EOR in a country where you have no legal entity, there is a real risk of triggering a Permanent Establishment (PE) under local tax treaties.
Ask your EOR directly about their track record with PE risk. Specifically, find out whether they proactively assess role types and activities that could create a taxable presence for your organisation. A provider that cannot articulate how they identify, flag, and mitigate PE risk is leaving you exposed to unexpected corporate tax liabilities and regulatory scrutiny.
Look beyond headline promises. Request historical performance data — hit rates against SLAs over the past 12 months. Strong EOR partners share this transparently.
Finally, ensure SLAs are country-specific where relevant. Payroll timelines in Brazil differ vastly from those in the Netherlands. Generic global SLAs without local nuance are a red flag.
Choosing an EOR is a strategic decision. Make sure your provider’s SLAs protect your people, your compliance posture, and your reputation. If you’re benchmarking EOR platforms, start by comparing their SLAs side by side — it reveals more than any sales deck.
